Terms of Service

By creating an account, logging in, or otherwise using the Service, you represent that you are at least 18 years old and have the legal authority to accept these Terms on behalf of yourself or the organization you represent.

You may be required to register an account to access certain features of the Service. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account.

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. You may not attempt to gain unauthorized access to any portion of the Service, accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.

EvacRoster offers paid subscription plans for access to premium features. By subscribing, you authorize us to charge the applicable fees to your chosen payment method. All fees are exclusive of taxes, and you are responsible for any applicable taxes. Subscriptions are billed monthly or annually as selected and will automatically renew unless cancelled in accordance with the cancellation procedures described in your account settings. We use Stripe for payment processing; no payment information is stored on our servers.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that time.

The Service may utilize Twilio for sending emergency SMS notifications. By using the SMS features, you consent to receive such messages and acknowledge that message and data rates may apply. You agree to provide accurate phone numbers and to indemnify EvacRoster and Twilio from any claims arising from your use of the SMS functionality.

The Service and its original content, features, and functionality are owned by EvacRoster and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software without our written permission.

You retain ownership of any data you submit to the Service. By uploading or entering data, you grant EvacRoster a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display such data solely for the purpose of providing the Service. You represent that you have all necessary rights to grant this license.

Your use of the Service is also governed by our Privacy Policy, which can be found at /privacy. Please review our Privacy Policy to understand our data practices.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. EVACROSTER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EVACROSTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) ANY CONTENT OBTAINED FROM THE SERVICE. EVACROSTER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO EVACROSTER FOR THE SERVICE DURING THE SIX (6) MONTHS PRECEDING THE DATE OF THE CLAIM.

You agree to defend, indemnify, and hold harmless EvacRoster and its subsidiaries, affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

We may suspend or terminate your access to the Service, without prior notice or liability, for any reason, including if in our sole discretion you violate these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us at contactus@evacroster.com.

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in England and Wales.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.
